Declaration of Covenants, Conditions, Reservations and Restrictions

for

Garden Valley Addition

 

 

The developer of Garden Valley has established the Declaration of Covenants, Conditions, Reservations and Restrictions (the "Declaration"?) to protect your investment in your home at Garden Valley.  The Declaration addresses a wide range of issues from the conduct of your builder, to the materials used in the construction of your home, to the homeowner' association, to trash collection and parking.  This summary of the Declaration will help you understand the basic provisions of the Declaration. Homeowner' Association

Every homeowner is automatically a member of the homeowners' association, which is called Garden Valley Association, Inc. ("GVA"?).  GVA is responsible for governing the day to day operation of the residential addition at Garden Valley.  GVA will set annual dues to cover the maintenance and repair of the common areas, including the entrance gate, the roads and the walking trails.  The developer will retain control of GVA during development, but the homeowners will control it afterwards.

 

Club Membership

All homeowners are required to join Garden Valley Golf Club at least as a Sports Club Member.  These dues will be minimal and will provide every homeowner with access to all amenities except the golf course.  We want to encourage all our homeowners to be active members of our community.  Further, we want to provide not only physical amenities but also a variety of social and athletic programs organized by our staff.  Of course, we would like all our homeowners to join as a Full Golf Member, but we realize that not everyone plays golf and thus do not want to burden every homeowner with the upkeep of the golf course.

 

Protective Covenants and Easements

The Declaration has the normal protective covenants setting guidelines for trash, pets, parking, outside storage, landscaping maintenance, signage, exterior noise, etc.  In addition, the Declaration grants utility and walking trail easements throughout the development, which will be shown on the plat of your lot.

 

Sidewalks and Walking Trails

The developer has worked with a land planning professional to plan a series of paths connecting the lots, common areas, lakes and amenities.  If the master plan shows a concrete sidewalk or crushed rock trail on your lot, you will be required to install it.  The developer will install the paths in the common and amenity areas, and once installed, GVA will assume responsibility for maintaining all the paths.
